Court:
To obtain custody of your grandchild, go to the Probate Court where the child lives and request temporary guardianship. In order to get guardianship of the child, his or her parent(s) must consent, must be found to be unfit or must be unavailable. The Clerk's office will have the paperwork necessary to get you started. You should bring the child's birth certificate with you if you have it.
Temporary guardianship means temporary. The biological parents have a right to be heard and contest your request. The court will set a date for a hearing
If the Probate Court awards you permanent custody of your grandchild, know that permanent does not mean permanent. The biological parent may petition Probate Court in the future for custody of the child to return him/her
You do not need an attorney. If you have legal questions, there's an attorney-of-the-day at each court
If you do not have the child's birth certificate when you apply for custody, the court may allow you to file it in the future

NOTE: If your grandchild is in the custody of DCF and you obtain custody in court - you may render yourself ineligible for the 'maintenance allowance', usually provided for Foster or Kinship Care. Please speak with DCF before you go into court
If DCF has custody of your grandchild, you have the right to ask to participant in a home study and have your grandchild placed with you as a kinship foster parent. If you become the child's foster parent, you should receive foster care payments. MassHealth for your grandchild, and other services. There are over 240 Public Housing Authorities (PHAs) statewide, many offering both state and federal housing. Though most give preference to those who live or work in their community, still apply to many communities as you would be willing to relocate to in addition to your local PHA.

Often referred to as "Section 8" - Mobile rental vouchers can be used anywhere in the community as long as the unit meets program requirements and rent limits. Vouchers are either federally or state funded
Apply for both types of mobile vouchers through WHA & RCAP Solutions
Waitlists for mobile vouchers are 10+ years unless you fall within priority categories (fire victim, victim of domestic violence, etc.). Make sure you check as many preferences as appropriate to decrease your wait time.
IMPORTANT TIPS FOR SUCESSFUL SUBSIDIZED HOUSING:
Get on as many different waiting lists as you qualify for despite the lengths. Remember, you will never get to the top of a waiting list if you are not on the waiting list
If a waiting list is closed, check back monthly to see if it is open
Keep a log of all the places you apply
When you move, make sure you update all the agencies where you applied of your new address. Correspondence is by letter and one missed letter WILL result being taken off the list! There is no exceptions
If you ae denied housing, immediately contact Community Legal Aid (CLA). People are often denied for a variety of reason but are successfully able to win an appeal of that decision. Time for appeal is very limited and you must act immediately

Everyone at one time or another falls on hard times. It's important to seek help BEFORE a financial problem becomes a crisis. There are many agencies that may be able to help with utility negotiations, landlord negotiations, advocacy, budgeting and some financial assistance
The earlier help is sought the more likely a positive outcome. Visit CMHA's Housing Counseling for assistance in working out an agreement with your landlord or to explore other housing options as early as possible

No fault fire, flood, natural disaster, condemnation or foreclosure
Fleeing domestic violence, current or within past 12 months
No fault eviction
Child(ren) are exposed to a substantial health and safety risk
Step 3: Provide all requested verification within 30 days. Ask for "presumptive placement" if you do not have all requested documents when you apply
Step 4: Health and safety assessment will be conducted to verify housing instability. This is done through DCF. This does not mean a 51A is being filed against you. Homelessness is not a legal reason to lose your children in Massachusetts
Step 5: If you are determined eligible for EA, you may be offered to choose HomeBASE benefits or shelter placement. If you are determined ineligible for EA, you will receive a denial letter. All denials may be appealed
